   An act to add Part 3 (commencing with Section 23000) to Division 9
of the Public Utilities Code, relating to aviation.

   AB 1197, as introduced, Gordon.   Aviation: Southern California
Regional Aviation Commission.
   The State Aeronautics Act governs the creation and operation of
airports in this state.
   This bill would establish the Southern California Regional
Aviation Commission with responsibility for the development of
strategies and policies to be employed by state and local
governmental entities to facilitate the regional distribution of
aviation services to existing airports throughout southern
California, as provided in the aviation component of the Southern
California Regional Transportation Plan and responsibility for
providing independent policy analyses and recommendations to the
Legislature and the Governor consistent with these duties. The bill's
operation would be contingent upon state funding in the annual
Budget Act or another statute.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Part 3 (commencing with Section 23000) is added to
Division 9 of the  Public Utilities Code , to read:

      PART 3.  REGIONAL AVIATION COMMISSIONS


      Article 1.  Southern California Regional Aviation Commission.

   23000.  For purposes of this article, the following terms have the
following meanings:(a) "Airport" means an airport in southern
California regularly serving an air carrier holding a certificate
issued by the United States Secretary of Transportation.
   (b) "Commission" means the Southern California Regional Aviation
Commission.
   (c) "Director" means the Director of Transporation.
   23001.  (a) There is hereby created the Southern California
Regional Aviation Commission. It is the intent of the Legislature
that the Southern California Regional Aviation Commission be
responsible for the development of strategies and policies to be
employed by state and local governmental entities to facilitate the
regional distribution of aviation services to existing airports
throughout southern California, as provided in the aviation component
of the Southern California Regional Transportation Plan and for
providing independent policy analyses and recommendations to the
Legislature and the Governor consistent with these duties.(b) The
commission shall be composed of the following members:
   (1) One representative of the City of Los Angeles, chosen by the
city council.
   (2) One representative of the City of Ontario, chosen by the city
council.
   (3) One representative of the County of Los Angeles, chosen by the
board of supervisors.
   (4) One representative of the County of San Bernardino, chosen by
the board of supervisors.
   (5) One representative of the County of Riverside, chosen by the
board of supervisors.
   (6) One representative of the County of Orange, chosen by the
board of supervisors.
   (7) One representative of the Los Angeles County Transportation
Commission, chosen by a majority of the voting members of the
commission.
   (8) One representative of the San Bernardino Association of
Governments, chosen by a majority of the members.
   (9) One representative of the Riverside County Transportation
Commission, chosen by a majority of the voting members of the
commission.
   (10) One representative of the Orange County Transportation
Commission, chosen by a majority of the voting members of the
commission.
   (11) One nonvoting member appointed by the executive committee of
the Southern California Association of Governments.
   (12) One nonvoting member appointed by the membership of the
Southern California Regional Rail Authority joint powers authority
that operates the commuter rail network known as Metrolink.
   (13) One nonvoting member appointed by the director.
   (c) The commission members shall serve at the pleasure of their
respective appointing authorities. The respective appointing
authority may appoint an alternate for each member who may, during
the member's absence, serve on the commission and vote on matters
before the commission on those matters where the member has a vote.
   (d) The commission shall, until a chair is selected pursuant to
subdivision (e), convene upon the call of the director.
   (e) The commission shall select a chair from among its members.
The chair shall hold office for a term of one year and may be
selected to successive terms. Upon selection of a chair, the
commission shall convene upon the call of the chair.
   23002.  (a) The commission shall develop strategies and policies
to be employed by state and local governmental entities to facilitate
the regional distribution of aviation services to existing airports,
as provided in the aviation component of the Southern California
Regional Transportation Plan, and shall provide independent policy
analyses and recommendations to the Legislature and the Governor.(b)
The commission shall develop strategies and policies and conduct
analyses and make recommendations as to all of the following:
   (1) Measures to facilitate ground access, both passenger and
cargo, to every airport.
   (2) Measures to facilitate the development of high-speed railroad
connections between all airports and population centers, to encourage
rail-to-airport travel for both passengers and cargo.
   (3) Measures to rationalize the distribution of aviation services
between all airports, to ensure the availability of aviation services
throughout southern California, including the setting of landing and
other fees.
   (4) Measures to facilitate the timely and efficient building of
airport infrastructure sufficient to service anticipated demand for
both cargo and passenger air travel.
   (5) Measures to provide incentives to encourage air carriers
providing passenger or cargo service to locate to regional southern
California airports.
   (6) Measures to improve the coordination of operations between
airports.
   (7) Measures that expand financing options for the development of
regional airports and ground access infrastructure to service those
airports.
   (8) Measures to reduce negative environmental impacts resulting
from aviation activities.
   (c) The commission shall conduct analyses and make recommendations
relative to the need for an ongoing regional aviation authority for
southern California, its mission, composition, and authority.
   (d) The commission shall not develop strategies and policies or
conduct analyses and make recommendations relative to the development
of new airports in southern California.
   23003.  (a) The commission shall meet, as often as the chair deems
it necessary to carry out its duties and responsibilities.(b) The
commission shall prescribe rules for the transaction of its own
affairs, subject to both of the following requirements:
   (1) The votes of all voting members shall be recorded.
   (2) Effective action shall require the affirmative vote of a
majority of all the duly appointed voting members of the commission,
not including vacant commission seats.
   23004.  The commission shall have power to require every airport
to submit data necessary to carry out its duties and responsibilities
and the director may exercise all powers and authority granted the
director to assist the commission.
   23005.  Each member of the commission shall receive a stipend of
fifty dollars ($50) for each day in which he or she attends any
meeting of the commission or any meeting of any committee or
subcommittee of the commission, of which committee or subcommittee he
or she is a member, and which committee or subcommittee meeting is
conducted for the purpose of carrying out the powers and duties of
the commission and, in addition, shall receive his or her actual and
necessary traveling expenses incurred in the course of his or her
duties.
   23006.  (a) The Department of Transportation shall prepare a
budget for the commission and be responsible for allocations.(b)
Funding for the commission shall be contributed in equal proportions
by the entities having voting members on the commission, with a
matching allocation from the Department of Transportation. No member
shall have voting participation on the commission unless the entity
appointing the member has made its funding contribution.
   (c) This article shall operate only during periods for which the
Legislature has appropriated funds therefore in the annual Budget Act
or another statute, as determined by the director.
