CAUTION. DO NOT SUBMIT A PROPERTY TAX APPEAL IF THE FAIR MARKET VALUE OF YOUR HOME IS GREATER THAN THE "TOTAL FULL VALUE" INDICATED ON THE NOTICE OF SECURED PROPERTY VALUATION POSTCARD WHICH WILL BE MAILED TO YOU BY THE ASSESSOR IN JULY. THE ASSESSOR CAN INCREASE YOUR VALUATION.

After getting Appeal Form, fill out following instructions below.


Information you need to know before completing the application:

Filing period:
Regular appeals, 7/2/97 through 9/15/97.

The application should be typed or printed in black ink.

Instructions for completing the application, by form line, or item number:

1. Applicant name, address and phone numbers.

2. Agent's name, address and phone numbers.
If someone is representing you, please provide this information.

3. Property identification information.
Your assessor parcel number is shown on the annual postcard mailed in July entitled "Notice of Secured Property Valuation". The property address/location should then be provided.

Property Type
Check the appropriate box, which is typically "single family residence/condo/townhouse."

Appeals Hearing Options
Usually your appeal will be scheduled before a hearing officer. A hearing officer is appointed by the Board of Supervisors. Having your case heard by a hearing officer is considered a convenient alternative to the formal Board proceedings. The meeting is informal and can be scheduled to accommodate those who are not able to attend day time hearings. You, your agent and the hearing officer must attend this hearing. The Appeals Board is composed of three citizens who act as liaisons between you and the assessor. It is their job to listen to your case and determine what value is correct for your property.

4. Value
A. Current assessment value
This may be located on your source document and may be labeled "Property Valuation", "Full Value", "New Base Year Value" or "Value as Reassessed".
B. Applicant's Opinion of Taxable Value
Provide your opinion of the value of your property. Regarding homeowners appeals, you will only need to fill out the boxes for land and improvements. The improvements box should be filled out for the value of the building.
*Note* The best evidence of a property's value is recent sales of similar properties. Comparable sales cannot include any sales That are 90 days or more after the date March 1,1997 for which value is being estimated. A local Realtor can be reached to provide you with "comps" which contain value information. You will need to be able to explain how this similar property compares to yours in terms of size, age, conditions, and other features. Fair market value is basically what the current selling rate is on similar properties.

5. Appeals Period Roll year is 97-98.
Mark the appropriate box for the type of assessment you are protesting and attach a copy of the notice or bill where indicated.

6. The Facts
Check box A to indicate your home value has decreased because of the El Toro International Airport.

7. Written Findings of Facts
If you desire to receive the written findings check the appropriate box. These are legal documents which explains the factual and/or legal basis for the Board's decision. The fee for this service is $134.00.

8. Signature
Sign, indicate location where document was signed, and date. Also print or type your name below the signature.

If the applicant is a Corporation, the signature of a corporate officer and title are required. A spouse, child, or parent may sign for an applicant without special authorization. In this case, please provide relationship to applicant.

IF THE EL TORO INTERNATIONAL AIRPORT HAS REDUCED YOUR PROPERTY'S VALUE, YOU CAN FIGHT BACK BY APPEALING THE ASSESSED VALUE OF YOUR HOME. THIS PROCESS IS A LEGAL REMEDY ALLOWED UNDER CALIFORNIA LAW AND IS AVAILABLE TO ALL HOMEOWNERS AND OTHER PROPERTY OWNERS.

THERE ARE SERVICES WHICH WILL COMPLETE THE FORM, PROVIDE COMP SALE VALUES, AND HANDLE AN APPEAL FOR YOU.  HOWEVER, YOU CAN PREPARE THE FORM YOURSELF.
