BACKGROUND:

The Newport Beach City Council recently asked the Board of Supervisors, "To support the preparation of an environmental document by the City of Newport Beach that evaluates the impacts of an amendment of the John Wayne Airport Settlement Agreement to extend the term [until 2025] with no change to the current legally permissible and authorized level of operations.”

John Wayne airport has an estimated physical capacity of about 14 million annual passengers. The number of passengers actually served is capped until 2005, by the “John Wayne Airport Settlement Agreement”, at no more than 8.4 million annual passengers – which is “the current legally permissible and authorized level of operations”.

On December 5, the Supervisors approved this request. The OC Register reported that, "The Orange County Board of Supervisors took the first step … toward extending flight restrictions at John Wayne Airport to 2025. The board unanimously agreed to work with the city to study extending a curfew on night flights and caps on the number of passengers and cargo flights now in place."

ARGUMENTS:
The main arguments for the Board’s YES vote are:
* The Board was agreeing to a study and not to any final decision on the JWA caps.
* We do not want more passengers and airplanes at John Wayne, harming Orange County quality of life.
* Night flight curfews are humane and should be continued at John Wayne airport. The present curfew arrangement and other restrictions expire in 2005.

The main arguments for a NO vote are:
* The County may need additional airport capacity to handle future growth and John Wayne is underutilized.
* Support for Newport Beach and for "NO John Wayne expansion" should be tied to support by Newport Beach for "NO El Toro".  The Settlement Agreement, which Newport Beach seeks to extend, contains language calling for a second county airport.
* Newport Beach sued to overturn Measure F, which would protect all airport O.C. communities.

“SHOULD THE BOARD OF SUPERVISORS HELP NEWPORT BEACH TO EXTEND THE RESTRICTIONS ON JOHN WAYNE AIRPORT UNTIL 2025 AT THE CURRENT AUTHORIZED LEVEL OF OPERATIONS?”

Some respondents were unhappy with, or unclear about the term “CURRENT LEVEL OF OPERATIONS” - which was used in the resolution by the Newport Beach City Council and by the Board of Supervisors.

Therefore, we have a follow-up question to learn more about how residents feel on this issue.  We want to know whether you voted “Yes” on the above question because you support efforts at:
* Maintaining the current level of PASSENGER SERVICE – e.g. carrying the same number of passengers at John Wayne, or
* Maintaining the current HOURS OF OPERATION – e.g. keeping the same night curfews at John Wayne, or
* BOTH.
