    An act to amend Section 5805 of the Business and
Professions Code, relating to interior designers.   An
act to add Section 65050.1 to the Government Code, relating to land
use.

   Existing law specifies a single local base reuse entity for
certain specified military bases subject to closure pursuant to the
federal Defense Base Closure and Realignment Act, and specifies a
procedure for the recognition of a single local reuse entity for any
military base that is closed in the state.  Existing law requires
that this entity be recognized as the planning authority for the base
by all state agencies and provides that it is the only entity that
is eligible for specified state benefits for use on the base.  These
provisions are repealed as of January 1, 2007.
   This bill would enact provisions that would govern the structure
and composition of a single local base reuse entity and its governing
body for a qualifying military base, as defined.  These provisions
also would be repealed on January 1, 2007.  
   Existing law governing interior designers places certain
restrictions contained in the Architects Practice Act on a certified
interior designer's or other person's ability to submit interior
design plans to local building officials.
   This bill would allow certified interior designers or other
persons to submit interior design plans to local building officials
without those existing restrictions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  
  SECTION 1.  Section 5805 of the Business and Professions 

  SECTION 1.  Section 65050.1 is added to the Government Code, to
read:
   65050.1.  Notwithstanding any other provision of law, this section
shall govern the structure and composition of a single local base
reuse entity for a qualifying military base.
   (a) Unless only one city, county, or city and county satisfies the
requirements of subdivision (b) for membership on the governing body
of the single local base reuse entity, the single local base reuse
entity for a qualifying military base shall be structured as a joint
exercise of powers authority formed pursuant to, and in accordance
with, Chapter 5 (commencing with Section 6500) of Division 7 of Title
1.
   (b) The composition of the governing body of the single local base
reuse entity for a qualifying military base shall be determined as
follows:
   (1) The county shall have five voting members on the governing
body of the single local base reuse entity.  If the governing body of
the county has five voting members, each of the elected members of
the county's governing body shall be a member of the governing body
of the single local base reuse entity.
   (2) Each city with zoning authority over 5 percent or more of the
land area of the qualifying military base shall have one voting
member on the governing body of the single local base reuse entity
for each full 5 percent of the land area of the qualifying military
base over which the city has zoning authority.
   (3) Each city with an adopted sphere of influence that covers 20
percent or more of the unincorporated land area of the qualifying
military base shall have one voting member on the governing body of
the single local base reuse entity for each full 20 percent of the
land area of the qualifying military base over which the city has an
adopted sphere of influence.
   (4) The number of voting members on the governing body of a single
local base reuse entity to which a city is entitled by virtue of its
adopted sphere of influence as set forth in paragraph (3), and its
zoning authority as set forth in paragraph (2), shall be additive and
not alternative.
   (5) Each city entitled by virtue of paragraph (2) or (3), or both,
to voting membership on the governing body of a single local base
reuse entity for a qualifying military base shall appoint the voting
member or members by action of the governing body of the city.
Members of the governing body of a city may serve on the governing
body of a single local base reuse entity for a qualifying military
base.
   (c) Subdivisions (a) and (b) shall not apply if a written
agreement setting forth the composition of an alternative single
local base reuse entity has been entered into by the county in which
the qualifying military base is located, and each city within the
county that either (1) has zoning jurisdiction over 5 percent or more
of the land area of the qualifying military base, or (2) has an
adopted sphere of influence that covers 20 percent or more of the
unincorporated land area of the qualifying military base.
   (d) For the purposes of this section, the following terms have the
following meaning:
   (1) "Qualifying military base" means a military base, as defined
in paragraph (1) of subdivision (a) of Section 65050, that meets all
of the following conditions:
   (A) It comprises at least 4,000 acres of land.
   (B) At least one-half of its land area is located within the
adopted sphere of influence of one or more cities.
   (C) It is located entirely within the boundaries of a county with
a population of not less than 2,500,000 persons, and not more than
3,200,000 persons, based upon the 2000 federal census.
   (D) It was formally closed on or after July 1, 1998.
   (2) "Single local base reuse entity" has the meaning given in
Section 65050.
   (3) "Sphere of influence" has the meaning given in Section 56076.

   (4) "Zoning authority" means the power and authority to adopt and
implement zoning regulations governing a portion of the qualifying
military base pursuant to and in accordance with Chapter 4
(commencing with Section 65800) of Division 1 of Title 7. 
 Code is amended to read:
   5805.  Nothing in this chapter shall  preclude certified interior
designers or any other person from submitting interior design plans
to local building officials.  In exercising discretion with respect
to the acceptance of interior design plans, the local building
official shall reference the Uniform Building Code.
