"This conveyance is made and accepted upon the following express
condition,
which shall run with said real property, shall operate as a condition
subsequent, and shall apply to and bind the Grantee, its successors
and
assigns, and all other persons acquiring any interest in said real
property
either by operation of law or in any other manner whatsoever, to
wit:
The real property hereinabove described shall not be used or occupied
in
whole or in part at any time hereafter for any industrial or manufacturing
purpose or for any other use or purpose except for an airport and
customary
appurtenances thereto, and aeronautical experimental uses, and recreational,
educational, pastoral, horticultural, agricultural, and residential
purposes; and if said property shall be used for residential purposes,
the
occupancy and use thereof shall be confined to persons of the Caucasian
race
exclusively. In the event the real property hereby conveyed,
or any part
thereof, shall at any time hereafter be used for any purpose other
than as
hereinabove authorized, and/or in the event said real property shall
be used
or occupied for residential purposes by persons other than members
of the
Caucasian race, then in any such event said real property and the
whole
thereof shall revert to the Grantor or its successors and assigns,
each of
whom, respectively, shall have the right in such event to re-enter
and take
possession of said land and the whole thereof and to remove all
persons
therefrom. Provided, however, that the Grantee shall have
the right to
develop water by means of a well or wells drilled on said real property
for
use thereon exclusively, but shall not sell, transport, or use such
water or
suffer the same to be sold, transported or used elsewhere for any
purpose
whatsoever.
To Have And To Hold to the said Grantee, its successors in interest,
subject
to the reservations and conditions aforesaid.
In Witness Whereof, the said Grantor has caused its corporate name
and seal
to be affixed hereto and this instrument to be executed by its President
and
Secretary thereto duly authorized, this 12th day of October, 1939.
