Measure S


The following is the County-Counsel's title and summary of Measure S.

Under the rules governing initiatives, the County-Counsel has latitude in summarizing a ballot measure, and his summary need not be acceptable to the framers and signers of the measure.  In this case,the wording selected was not acceptable to the signers but they were unable to change it.

Measure S sought to repeal Measure A, the 1994 act that mandated a commercial airport at El Toro.  As required by law, most of the language of Measure S was a restatement of Measure A, with the objectionable language crossed out.

The Purpose of Measure S as stated by its signers was, "The initiative recognizes that the highest and best civilian use of the El Toro Marine Corps Air Station is not a civilian airport.This initiative cancels in its entirety, the initiative known as Measure A..."

The law required that those who oppose an airport must vote "yes" to cancel Measure A.  There was voter confusion, since "yes" on S meant "no" on the airport.

The petition was signed by Bill Kogerman, Bertram Hack and Thomas Whaling.

INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO THE VOTERS

The County Counsel has prepared the following title and summary of the chief purpose and points of the proposed measure:

BALLOT TITLE: INITIATIVE TO AMEND THE ORANGE COUNTY GENERAL PLAN TO REPEAL
MEASURE A AND DESIGNATE EL TORO MARINE CORPS AIR STATION FOR HIGHEST AND
BEST USES, NOT LIMITED TO COMMERCIAL AIRCRAFT USES

BALLOT SUMMARY: The measure would repeal the Initiative known as Measure A and adopted by the
voters on November 8, 1994. This includes abolishing the El Toro Airport Citizens Advisory
Commission. It also provides that certain unincorporated lands which are part of the El Toro Marine
Corps Air Station (MCAS) shall be used for their highest and best uses, not limited to commercial air
craft uses. That land lies within the area bounded by Irvine Boulevard to the northeast, Alton Parkway
and the city limits of the City of Irvine to the southeast, the A,T & SF Railroad to the southwest, and
Sand Canyon Avenue to the northwest.

The measure states that in order to ensure that any reuse plans for the El Toro MCAS site fully consider all
options and their implications, any planned commercial airport use at the site must be ratified by a majority of
the voters or Orange County.  In addition, any commercial airport planned and/or developed at the El Toro
MCAS must have a valid Environmental Impact Report prepared and any and all significant environmental
effects must be mitigated to a level of insignificance.

The Initiative also makes conforming General Plan amendments to the land use, noise, public services and facilities, safety, recreation and resources elements of the County General Plan. The General Plan amendments proposed by the Initiative would expire on December 31, 2015.
